In the face of great adversity Martin Luther King Jr preached for equality and peace.  He stood behind what was right, not what was simple, or what was accepted.  He did not advocate for violence, or hatred, but for the rights which all Americans are granted through the constitution which governs us all.

Dr. King was born on January 15th 1929 in Atlanta.  He graduated high school at age 15, and received his Ph.D. at age 26 from Boston University.  He led the black boycott (1955-56) of segregated city bus lines and in 1956 gained a major victory and prestige as a civil-rights leader when Montgomery buses began to operate on a desegregated basis.  His philosophy of nonviolent resistance led to his arrest on numerous occasions in the 1950s and 60s. His campaigns had mixed success, but the protest he led in Birmingham, Ala., in 1963 brought him worldwide attention. He spearheaded the Aug., 1963, March on Washington, which brought together more than 200,000 people. In 1964 he was awarded the Nobel Peace Prize.  On Apr. 4, 1968, he was shot and killed as he stood on the balcony of the Lorraine Motel (since 1991 a civil-rights museum).

The holiday honoring Dr. King’s birth and the achievements during his life was created in 1983, making it one of the most recent U.S. holidays.  What many do not know, however, is that it is two holidays in one.  There’s the overall King Day, set in ’83 when President Reagan signed a bill putting it in federal law. And there’s the Martin Luther King Jr. Day of Service, established when President Clinton signed the King Holiday and Service Act of 1994. King Service Day is meant to be a day of personal action in Dr. King’s memory on or near his holiday – as its boosters say, a day on, not a day off. It’s promoted by the Corporation for National and Community Service, a federal agency that also runs AmeriCorps and similar initiatives.

Most recently, on August 28th 2011, a memorial was erected and dedicated on the Mall in Washington DC in honor of Dr. King and his long-standing achievements and contributions to our country.

So, if you are at work, or enjoying a day off today, take time to reflect upon the meaning of this holiday.  What, and who, it stands for.  Take the time to listen to Martin Luther King Jr’s famous speech at the foot of the Lincoln memorial now nearly five decades ago.  Reflect upon your fellow man and the injustices which still exist in this world and question how you can not simply do what is easy, but what is right.  Consider how you can contribute to your community and make a difference that will let Dr. King’s famous words, “I have a Dream” continue to ring on.

Attorney Jeffrey Feulner and the Men’s Divorce Law Firm believes in the magic of fatherhood and the strength of the bond which a father shares with his kids.

The plot surrounding the 72-day marriage thickens and the TV stations can only hope the ratings improve as a result.  Unsurprisingly, Kris Humphries did not accept the divorce completely peacefully and has decided to counter-file for an annulment of the marriage.  As a result, and despite the lack of kids and iron-clad prenuptial agreement, the couple could be gearing up for a legal battle.

“There’s a clear conflict if one spouse is seeking a divorce, but the other wants an annulment,” says family law attorney Scott Weston, who is not involved in the case. “A judge will have to decide which to allow, which could take many months.”

But a source close to Kardashian says that a battle may be avoided.

“She always wanted an annulment but attorneys were against it so she’s happy that both parties agree now,” says the source.

In his Superior Court filing, Humphries marks the box reading “nullity of voidable marriage” and checks as the basis the box saying “fraud.”  He has said he now feels he was just a pawn in a reality show.

Under California law, a nullity is granted if the court finds that no valid marriage ever occurred. Along with fraud, grounds for an annulment include bigamy, incest, force or if the couple are under the age of consent.

Humphries’s papers say that if he’s denied an annulment then he wants a legal separation – not a divorce.

However, Kris Humphries and Kim Kardashian do agree on one point in this whole mess: the date of separation, which he also lists as Oct. 31.

“Getting ready for trial in a divorce or child custody case can be a stressful time as litigants and litigators attempt to condense the details and documents of a relationship into the hours or days of a trial. If you’re represented by counsel, it is your attorney’s job to prepare you for trial and to deliver a concise and convincing presentation of your case to the court. That said, since judicial determinations are often based upon the behavior a party exhibited in the courtroom rather than the exhibits they offered into evidence, please consider the following helpful hints for your day in divorce or custody court:

1. Do not roll your eyes, mutter under your breath or otherwise gesticulate when your spouse is testifying. Although justice may be blind, most judges are not. To the contrary, they are usually astute observers of body language who rarely appreciate one party’s use of facial expressions to mock the other spouse’s testimony. If your spouse is misrepresenting facts to the court, pass a few brief written comments to your attorney and patiently await their brilliant cross examination.

2. Do not keep referring to your child as “my” son or “my” daughter. More often than not, a parent who consistently uses the singular possessive pronoun with regard to the children is a parent who is singularly possessive about who should raise them.

3. Make sure that you’ve disclosed relevant and potentially embarrassing personal facts to your attorney early on in the case. Many years ago when I was a public defender, I represented “Jordan” who was charged with driving under the influence of alcohol. At the first office appointment, Jordan provided me with a detailed description of his performance on the roadside sobriety test, but he neglected to mention that when he exited the vehicle he was wearing a “teddy” negligee and a pair of high heels. Although Jordan’s was a criminal case which was resolved without a trial, his story bears repeating for divorcing spouses whose personal habits are relevant to their case.

4. Don’t bring your entire extended family and ten of your closest friends to your divorce hearing. During a marriage, most spouses would think twice about sharing their income tax returns or the intimate details of their relationship with third parties. When a marriage is ending, some divorcing spouses abandon this rule of privacy and assume that inquiring minds want to know everything about the divorce. If you need a support system to get you through the trial, pick no more than two people to sit quietly in the bleachers of the courtroom.

5. Don’t wear your torn blue jeans, your muscle shirt or your mini skirt to divorce court. Strange but true, months of trial preparation can be undone in an instant by a client who is dressed to tease rather than to testify. A provocative outfit may be great for the weekend after your divorce but it’s a fashion disaster for your custody case. When you select your courtroom attire, pretend you’re heading for a job interview. In some respects, you are.

6. Do not be rendered speechless if you’re asked to describe the positive aspects of your spouse’s parenting. A child custody case can be won or lost with the single question, “Can you describe some of the positive aspects of your spouse’s parenting skills?” On occasion, this question is followed by a pregnant pause as the witness scrambles to identify one favorable aspect of the other party’s parenting. If you can’t say anything positive about your spouse to the court, you’re probably not saying anything positive about your spouse to the kids.

7. Don’t display open hostility toward your spouse’s attorney. Your spouse’s attorney is probably not on your Christmas list. If you’re openly hostile toward opposing counsel during your cross-examination, you’re probably scoring more points for the other team than for yours. Keeping your cool on the witness stand is a great way of saying that you have nothing to hide.

8. Don’t read or receive text messages during the hearing. If you want the Court to pay full attention to the testimony, make sure that you do the same.

9. In a child custody dispute, don’t keep talking about “your” needs and “your” desires. Custody cases are determined based upon “the best interests of the child”. At trial, it is a safe assumption that the court doesn’t particularly care about you or your spouse, but the court cares deeply about the child(ren) you have created together.

10. Don’t tell long winded stories with irrelevant details of your spousal disputes. In divorce court, most judges have full dockets, sore backs and a desire to make it to lunchtime without an emergency hearing. If you’re asking the court for a protection order, describe the alleged spousal abuse and avoid the temptation to explain the minute details of the domestic dispute which precipitated the abuse.

Hopefully, my top ten tips will improve your odds at trial although there are no guarantees of success in the world of litigation.”

Twilight fans are hardly subtle with their crazes, from “Team Edward” to “Team Jacob” t-shirts and more Twlight has swept the nation.  As a result, the radio show “Rollin’ With Nick Cannon” has something worth more than gold (or relationship security, apparently) to these Twilight fans: tickets to a special preview of the new movie “Breaking Dawn” a day before the movie is released in theaters.

But these tickets aren’t given out for free, or even just to “lucky caller number 7,” they want their contestants to work for them.

Playing off of the name, “Breaking Dawn,” the radio hosts are asking people to break the hearts of their significant others on air.  The rules are simple: the participants cannot mention the tickets, indicate they are on air, let their significant other know its for a radio show, and must break the person’s heart.  Co-host Sarah Lee said she wanted to, “hear [their heart] shatter.”

At first, you may think that no one would dare put their significant other through such an ordeal just for some movie tickets.  However, a slew of contestants (mostly women given the subject matter) happily put their boyfriends, fiancees, even husbands on the air and mock (or seriously) broke up with them.

The article on 92.3′s website claims that (in their opinion) the relationship was made stronger from the ordeal.  But we could imagine a discussion might have occurred when the women got home.

Veterans day is a time for remembrance and thanks to the fearless few who stand for people who they have never met, and will never have the chance to meet.  The people who believe in our country, serve its leaders, and in many cases pay the ultimate price for freedom for us all.

In November 1919, President Wilson proclaimed November 11 as the first commemoration of Armistice Day with the following words: “To us in America, the reflections of Armistice Day will be filled with solemn pride in the heroism of those who died in the country’s service and with gratitude for the victory, both because of the thing from which it has freed us and because of the opportunity it has given America to show her sympathy with peace and justice in the councils of the nations…”

At the end of World War I the United States Congress officially recognized and changed the day to Veteran’s Day to continue to honor those who served in the war, and wars to come.

Take the time today to vocalize the gratitude you feel for our nation’s soldiers.  Let them know you respect their sacrifices and how they have touched your lives without ever knowing them.

Kim Kardashian cancelled on a scheduled appearance at an Australian horse racing event to return home and deal with the fallout and emotions from her surprising divorce.  This was yet another mixed signal from the star, when earlier in the week she repeated in interviews in Australia  that she “really didn’t want to bail on everyone.”

However, she did spend enough time in the land down under to plug her new handbag line.

Kim met her husband, basketball player Kris Humphries, on October 31st 2010.  She filed for divorce due to “irreconcilable differences”and on her website she insisted that she married for love and it just didn’t “turn out to be the fairytale” she wanted.

Where is the 26 year old NBA star in all of this?  Humphries has been sighted around his Minnesota hometown still wearing his wedding band.  Being a more private person he has not discussed any marital problems with friends, family or paparazzi.  However, he did make a statement to US Weekly saying, “I’m committed to this marriage and everything this covenant represents. I love my wife and am devastated to learn she filed for divorce. I’m willing to do whatever it takes to make it work.”

Assuming the couple goes through with the divorce an iron-clad pre-nup protects Kim from loosing any property to Humphries.  Anything she has earned during the marriage is hers to keep.  But there is one thing Humphries and Kim: Profits from their E! Wedding Special that reached over 4 million viewers.  Kim and Kris earned 30% revenue from every commercial that aired, since the wedding special aired in about 50 countries that ended up being a large sum.

As questions and accusations about the marriage’s legitimacy get thrown around by fans and friends alike it is important to remember that the product of television drama has been the Kardashian’s product since their show “Keeping up with the Kardashian’s” aired in 2007.

“I think you try to milk it and say you’re not going to milk it,” said Derek Baine, a cable TV analyst for SNL Kagan, talking about E! News‘ coverage of the Kardashians. “You don’t want to seem real crass and taking advantage of a personal tragedy. In fact, it’s their job to boost the ratings. There’s nothing like a good car wreck.”

Suzanne Kolb, President of E! Entertainment had this to say about this season of the Kardashians, “The show is obviously going to have more drama in it that we originally expected with a newlywed couple.  At the same time, people are going to be able to see how difficult this was for the two of them.”
